Gun Law Nullification Act of 2025

Preamble:

Recognizing the diverse interpretations of the Second Amendment and aiming to address the complexities surrounding gun ownership, this bill seeks to reset the legislative framework concerning firearms within the United States.

Section 1: Title

This act shall be known as the “Gun Law Nullification Act of 2025.”

Section 2: Nullification of Existing Gun Laws

(a) Immediate Effect: All federal, state, and local laws, regulations, ordinances, and administrative rules concerning the control, manufacturing, ownership, sale, transfer, carrying, or use of firearms are hereby declared void and of no effect.

(b) Scope: This includes, but is not limited to:

Background checks

Licensing requirements

Restrictions on types of firearms (e.g., assault weapons bans)

Age restrictions on gun ownership or purchase

Concealed carry permits

Open carry laws

Restrictions on magazine capacity

Laws regarding the sale or transfer of firearms at gun shows or private sales

Section 3: Exceptions

This act does not nullify:

Laws concerning the use of firearms in the commission of a crime

Laws prohibiting felons from possessing firearms

Laws regarding the safe storage of firearms to prevent access by minors or unauthorized persons

Section 4: Repeal of Agencies and Departments

(a) Any federal, state, or local government agencies or departments established specifically for the enforcement of now-nullified gun laws shall be dissolved.

(b) Employees of these agencies may be reassigned or offered severance in accordance with existing labor laws and agency policies.

Section 5: Legal Proceedings

(a) Pending Cases: All legal proceedings related to violations of now-nullified laws shall be dismissed immediately.

(b) Convictions: Individuals previously convicted under now-nullified laws may petition for a review of their case with the aim of expungement or reduction of charges.

Section 6: Effective Date

This act shall take effect immediately upon passage.

Section 7: Severability

If any provision of this Act or the application thereof to any person or circumstance is held invalid, the remainder of the Act and the application of such provision to other persons or circumstances shall not be affected thereby.

Section 8: No Precedent for Future Legislation

The nullification of these laws does not set a precedent for the nullification of other types of legislation.

In a word . . . no, that word is not appropriate for this site.

Instead, I’ll just say that the proposal improves nothing and makes many things worse.

I’m a stauch 2A supporter. I’ve used and carried firearms for more than 70 years.

If anything should be changed about firearms, 2A should remove references to any militia and openly state that it is the right of people to keep and bear arms of their choice without restriction by state, local, or federal government. If I thought it possible to define with any amount of reasonableness what they are, I might agree to a stipulation that no individual has the right to keep and bear and use weapons of mass destruction. The devil is in the definitions. :innocent:
